The national police of Ukraine needs to immediately hold an extraordinary meeting of the Commission of the Ministry on scrap metal to suspend its illegal decisions on the export of scrap metal.
To suspend the procedure for issuing, registering and issuing cards for transactions with scrap metal, as well as terminate the registration of contracts and issuance of new cards requires the Department to protect the economy of the National police of Ukraine – he wrote in his letter to the Ministry of economic development and trade of Ukraine of April 5, 2016.
At the request of the National police Commission to scrap the Ministry shall, in accordance with article 23 of the law of Ukraine On the National police immediately, until April 8, to hold its meeting and to suspend orders No. 446 of 16 March 2016 and No. 519 of March 28, 2016, under which the Commission has allocated export quotas of 450 thousand tons of scrap metal, and to suspend the procedures of customs clearance of export operations with scrap metal.
As reported in a letter to the National police, the distribution of export quotas was held in defiance of the judgment of the District administrative court of Kyiv, which was suspended by order of the Ministry About the statement of the estimated balance of education and consumption of scrap in the domestic market in 2016 No. 337. The decision of the District administrative court, according to the letter of the National police, employees of the Ministry of economic development is not brought to the knowledge of the members of the Commission, although aware of its existence.
At the extraordinary meeting, the Commission shall suspend the procedure of issuing, registration and issuance of registration cards-accounting for operations with scrap metal and terminate the registration of contracts and issuance of registration cards-exchange on the basis of orders of MEDT No. 446 and No. 519, which was mentioned above. Based on the content of the letter, the Ministry must notify the State fiscal service about the need for the suspension of customs clearance contracts for the export of scrap. The suspension of these decisions should continue until the adoption of the District court of Kiev the final verdict on the legality of the order of the Ministry about the balance scrap No. 337.
